These general conditions are valid for all purchasing and delivery contracts concluded on the METTLER-SEIFEN AG (hereinafter referred to as: METTLER) website. Any deviations are only valid with the formal written approval of METTLER.
EFFECTIVE CONCLUSION OF A CONTRACT
The contract between the purchaser and METTLER takes effect only with written confirmation of the order received by METTLER, at the latest, however, with acceptance of delivery. The customer's order is placed via METTLER’s website. If METTLER does not reject the order within 72 hours then it is considered accepted.
Payment takes place online and beforehand with respective approved debit or credit cards.
METTLER only sends goods purchased online within Switzerland. Dispatch takes place once payment has been fully received and at the recipient's risk.
DELIVERY COSTS AND MINIMUM ORDERS
Standard delivery: CHF 9.80, no delivery costs will be charged to orders over CHF 100.
Unless order confirmation states otherwise delivery will take place within 3 – 5 working days of payment being received if not stated otherwise in the order confirmation of METTLER. If a delivery fails to reach the purchaser within 10 working days the purchaser can submit a written reminder and stipulate an additional period of 10 days. After this time expires the purchaser may withdraw from the agreement. Withdrawal is only valid if explained in a registered letter. All claims asserted by the purchaser regarding late delivery or withdrawal claims are categorically waived.
Incorrect delivery, quantity deviations and recognizable shortcomings or damages must be reported to METTLER in writing immediately and no later than two working days after delivery. Notification of hidden defects may be submitted in writing up to a maximum of 6 months after delivery. Return deliveries will only be accepted by prior arrangement, with all accessories and with a copy of the invoice. The purchaser is responsible for suitable transportation and for delivery costs. METTLER is free to decide if a defective delivery should be repaired or fully or partly replaced. All other warranty rights are expressly waived. METTLER excludes any liability for direct or indirect damages.
All prices stated on the Internet are without obligation. Price adjustments and model changes are reserved and may be made at any time without prior notification or justification. Should there be changes during an order processing due to increased costs, additional fiscal encumbrances, increased customs duties or severe currency fluctuations, then METTLER reserves the right to adjust the respective prices.
The prices stated include statutory value-added tax.
METTLER only saves data necessary for business processing. All personal data shall be treated as confidential and shall not be passed on for advertising purposes.
LIABILITY FOR TECHNICAL PROBLEMS
In the frame of legal admissibility METTLER refuses to accept any liability for damages which result from temporary or lasting technical problems and/or failures in operations with their website, e-mail system or any other technical facilities. They especially reject any liability for interruptions in transmission, loss of data, safety deficiencies etc. METTLER is also not liable for damages arising within the frame of inappropriate actions and disregard to risks on the part of the customer or a third party, inappropriate demands and/or unsuitable operating facilities or the customer or third party, force majeure, ambient conditions, intervention of the purchaser or destruction by a third party, attack by destructive programs such as viruses, bugs etc. whether due to gross negligence and/ or by intention.
These terms of business and all business concluded by METTLER on their website are solely subject to Swiss law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods of April 11th 1980 (UN purchasing law / CISG). As far as is legally permissible Zurich in Switzerland is the only venue of jurisdiction for both parties. Purchasers cannot transfer rights and duties from this agreement to a third party. In case of doubt the German language version of the business terms and conditions is authoritative and overrules any other language versions.
These terms and conditions of business replace any previous agreements and business conditions between the parties.
